Forma Construction Solutions Inc. (“Forma Construction,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through formagc.net (the “Site”) and our business communications, how we use and share it, and the choices and rights available to you, including rights recognized under U.S. state privacy laws. This Policy applies to visitors and customers regardless of the state in which they reside.
1. Information We Collect
Information you provide to us
- Contact details: name, phone number, email address
- Project details: the type of work you're requesting and any message or description you submit
- Any other information you choose to include when contacting us by form, phone, email, or text
Information collected automatically
- Device and usage data: IP address, browser type, pages visited, referring URL, and approximate location derived from IP address
- Cookies and similar tracking technologies used for analytics, advertising measurement, and call attribution (see Section 3)
- Call data: if you call a phone number displayed on our Site, our call-tracking provider may record the call (with notice) and log the number you called from and the webpage that displayed that number
2. How We Use Information
- To respond to your quote requests and communicate about your project
- To schedule, perform, and invoice for construction services
- To send confirmations, service updates, and — where permitted — marketing communications you can opt out of at any time
- To measure and improve the Site and our advertising, including which marketing channels drive calls and form submissions
- To comply with legal obligations, licensing requirements, and to protect against fraud or misuse of our Site
3. Cookies, Call Tracking & Advertising Technologies
We and our service providers use the following categories of tracking technology:
- Call tracking (CallRail): dynamically swaps the phone number displayed to you so we can measure which marketing source drove your call, and may record calls with notice for quality and training purposes.
- Analytics and advertising (e.g., Google Analytics, Google Ads): where enabled, these help us understand Site usage and measure the performance of our advertising campaigns, and may use cookies or similar identifiers to recognize your browser across visits.
You can control cookies through your browser settings. Blocking cookies may affect some Site features. Where required by law, we honor opt-out preference signals such as the Global Privacy Control (GPC).
4. How We Share Information
We do not sell your personal information for money. We share information only with service providers who process it on our behalf, under contract, for the purposes described in this Policy:
- Supabase — secure database hosting for lead and contact records
- Brevo — sending email notifications and, where you've opted in, marketing emails
- CallRail — call tracking, number swapping, and call recording
- Vercel — website hosting and infrastructure
- Google (Analytics/Ads) — website analytics and advertising measurement, where enabled
Depending on your state of residence, sharing information with advertising or analytics partners for cross-context behavioral advertising may be considered “sharing” or a “sale” under that state's privacy law even though no money changes hands. You can opt out as described in Section 6. We may also disclose information if required by law, subpoena, or to protect the rights, property, or safety of Forma Construction or others.
5. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are recognized, in varying forms, under laws including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and similar comprehensive privacy laws enacted in Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Kentucky, Rhode Island, and other states as they take effect:
- Right to know / access — request what personal information we have collected about you and why
- Right to correct — request correction of inaccurate personal information
- Right to delete — request deletion of your personal information, subject to legal exceptions (e.g., records we must keep for licensing or tax purposes)
- Right to data portability — request a copy of your information in a portable format
- Right to opt out — opt out of the sale or “sharing” of your personal information, and of targeted advertising or certain profiling
- Right to non-discrimination — we will not deny services, charge different prices, or provide a different level of service because you exercised a privacy right
- Right to appeal — in states that provide it, you may appeal a denied request as described below
We apply these rights to all requesters consistent with applicable law, regardless of which state's specific statute technically applies to our business.
6. How to Exercise Your Rights
To submit a privacy request, email us at info@formagc.net or call (786) 761-5587. To protect your information, we may need to verify your identity before completing certain requests. You may also designate an authorized agent to submit a request on your behalf, subject to verification. We will respond within the time required by applicable law (generally 45 days, extendable once by an additional 45 days when reasonably necessary). If we deny your request, and your state provides an appeal right, we will explain how to appeal in our response.
7. Text Messages & Phone Calls
We do not send unsolicited or marketing text messages. If you contact us first — by submitting a form, calling, or texting a number displayed on our Site — we may reply by text message solely to continue that specific conversation about your quote request or project. We do not use your number to start new text conversations you haven't initiated, and we do not send recurring or automated marketing texts. Message and data rates may apply. You can end a text conversation at any time by replying STOP, and you can ask to stop receiving calls by telling us directly.
8. Email Communications
Transactional emails (such as confirming we received your request) are sent to fulfill your request and are not promotional. If we send marketing emails, every message includes an unsubscribe link, and we honor opt-out requests promptly in compliance with the CAN-SPAM Act.
9. Children's Privacy
Our Site and services are directed to adults seeking construction services and are not intended for children under 13 (or under 16 where applicable state law requires additional protection). We do not knowingly collect personal information from children.
10. Data Retention
We retain personal information for as long as needed to respond to your inquiry, perform any contracted services, meet our legal, tax, licensing, and insurance recordkeeping obligations, and resolve disputes, after which it is deleted or anonymized.
11. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encrypted data transmission (HTTPS) and access-controlled database storage. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
12. Third-Party Links
Our Site may link to third-party websites we do not control. This Policy does not apply to those sites, and we encourage you to review their privacy policies separately.
13. Changes to This Policy
We may update this Policy from time to time. The “Effective date” above reflects the last revision. Material changes will be reflected on this page.
